Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and TechitEasy (“TechitEasy”, “we”, “us” or “our”) and govern your access to and use of our websites, applications, and related services (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” refers to that entity.

1. The Service

We provide software and related services as described on our website and in any applicable order or plan. We may update, add, or remove features, functionality, and limits from time to time as we improve the Service. We may also establish reasonable usage limits and policies governing use of the Service.

2. Accounts and eligibility

• You must provide accurate account information and keep it up to date.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You must be at least 18 years old and legally able to enter into these Terms.
• Notify us promptly of any unauthorized use of your account.

3. Third-party services

Your use of those third-party services remains subject to their own terms and policies, and you are responsible for complying with them. We are not responsible for, and do not endorse, the availability, content, or conduct of any third-party service.

You are solely responsible for the data and content you submit to or generate through the Service and for ensuring you have all rights and permissions necessary to do so.

5. Compliance with laws

You are responsible for complying with all laws and regulations applicable to your use of the Service, including data protection, privacy, and electronic-communications laws. You must maintain an appropriate lawful basis for any personal data you process through the Service.

6. Fees

If your plan includes fees, you agree to pay all charges associated with your subscription. Unless stated otherwise, fees are non-refundable and exclude applicable taxes. We may change pricing on a prospective basis with reasonable notice.

7. Intellectual property

We retain all rights, title and interest in and to the Service, including all related software, designs and trademarks. You retain ownership of the content and data you provide. You grant us a limited license to host, process and use that content solely to provide and improve the Service.

8. Confidentiality

Each party may receive information that is confidential to the other. Each party agrees to protect the other’s confidential information with reasonable care and to use it only as necessary to perform under these Terms.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any particular result will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to these Terms will not exceed the amounts you paid for the Service in the twelve months preceding the event giving rise to the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or third parties. Upon termination, the rights granted to you under these Terms will end, and sections that by their nature should survive will continue to apply.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which TechitEasy is established, without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except where applicable law provides otherwise.
